Rape, Cosby and UVA

A story in Rolling Stone featured the alleged gang rape of a University of Virginia student, launching calls for reform and more attention to the issue of sexual assaults on campus. Recent reporting by the Washington Post, however, has raised doubts about the veracity of the story.

How aggressively did journalists pursue the facts?

Rape became big news with allegations against Comedian Bill Cosby and an explosive Rolling Stone story describing a gang rape of a co-ed at a fraternity house on the University of Virginia campus, for which editors later apologized for “discrepancies.”

Both rape stories raised questions about how journalism works in America and whether it can be trusted.

Where were the editors while these stories were being covered? Tough editors ask tough questions, and demand answers from their own reporters about how they got the story and whether it’s supported by hard investigation.

Media are accused of failing to dig into serial rape accusations over decades against Cosby, who was seen as a popular father figure as he was portrayed on his television show.

About 20 women have accused Cosby of drugging them, and often raping them. But he has not answered to what he calls “innuendos.” Some of the accusers have been challenged. Cosby’s most recent comment is that his wife is dealing well with the controversy.

Pushing back, Cosby’s lawyer accuses a reporter of deception, and his wife, Camille, contends the media failed to take a close look at her husband’s accusers.

The Rolling Stone gang rape story by Sabrina Rubin Erdely is based on a single source, a woman identified only as “Jackie,” who claimed she was lured to a 2012 fraternity party by a man named “Drew,” and raped by seven men. The Washington Post described the story.

Good reporting usually involves getting all sides of the story. Erdely admitted that she made a deal with Jackie that no attempt would be made to find and interview anyone else involved in the alleged rape, or knew about it.  And her editors allowed her to get away with a violation of a basic tenet of good reporting – getting multiple sources to verify the accuracy of the story

The editors allowed this unusual dispensation from careful reporting because the story was “sensitive.” Yes, rape is a sensitive issue, but not a reason to suspend professional standards in reporting. Sensitive stories require more careful reporting, not less.

The Society of Professional Journalists code of ethics urges caution in reporting sex crimes.

The story was widely reported and put a spotlight on campus rape. Then came questions about its accuracy. The accused fraternity had no party on the night the rape allegedly happened, and issued a statement saying that sexual assault was not “part of our pledging or initiation process.” It appeared to be fabricated and continues to be called into question from many sources.

Media followed the story as a lesson in journalism and ethics. A defamation suit against Rolling Stone is a possibility.

Rolling Stone’s managing editor, Will Dana, issued a statement:  “In the face of new information, there now appear to be discrepancies in Jackie’s account, and we have come to the conclusion that our trust in her was misplaced.”

Other media noticed the discrepancies. Pittsburgh Post-Gazette Columnist Jack Kelly calls the story “an unforgivable breach of journalism ethics” and thinks the fraternity house should sue Erdely and Rolling Stone for libel.

Rolling Stone editors believed Jackie was credible, according to Leslie Loftis in the Columbia Journalism Review,  because of a bias – a willingness to believe Jackie because “everyone knows that there is an epidemic of rape on campuses around the country….”

It’s what you know, or want to believe, that can set a trap.

The editors at the Washington Post wanted to believe one of their bright and upcoming reporters, Janet Cooke. She wrote “Jimmy’s World,” a story about an 8-year-old heroin addict in a family of addicts. Narcotics addiction was a big issue in 1980.

That story was so good, it won a Pulitzer Prize in 1981.

Then came the questions. A Washington Post editor asked Cooke to get in a car and go with him to identify where Jimmy lived. They drove around and could find no Jimmy. Cooke eventually admitted she invented Jimmy.

Cooke said the Post’s high-pressure newsroom corrupted her judgement. She said she had heard about somebody like Jimmy. She decided to write the story, based on anonymous sources, to satisfy her editors, she said.

The Post’s ombudsman wrote a long critique on the “Jimmy’s World” story, and found that the editors bore heavy responsibility, adding that “everybody who touched this journalistic felony was wrong.”

Good editors are supposed to do the hard work of keeping stories honest.

“Don’t tell me what you think, chum. Tell me what you know!” said a fabled, crusty editor at the former City News Bureau of Chicago, once called the Devils Island of Journalism. He grilled his reporters as vigorously as he expected his reporters to grill their sources.

James Foley was an American photojournalist who captured the gruesome images of savage warfare, until he became one of those images himself.

Foley, 40, dressed in prisoner orange with a shaved head, is seen kneeling next to a masked, black-clad man holding a knife. Kidnapped in Syria almost two years ago, Foley seems to grimace as the masked man clutches his shirt from behind.

A video posted on YouTube, then taken down, reportedly shows Foley decapitated, his bloody head detached from his body and resting on his back. Two U.S. officials said they believe the video is authentic.

Journalistically, one of the issues in reporting on Foley is whether the grim photo, which seems to show the journalist in the last moments of his life, should have been published.

The New York Post and the New York Daily News gave the photo front-page exposure, causing Washington Post reporter Abby Phillip to ask if the tabloids had gone “too far by printing gruesome images of James Foley’s execution.”

The Society of Professional Journalists code of ethics encourages sensitivity in the use of photographs involving those caught up by tragedy or grief, and “avoid pandering to lurid curiosity.”

For tabloids, that can be a challenge. The rule seems to be the more shocking, the better, and big images are best

This is not the first time the New York Post is seen as going “too far.” On Dec. 4, 2012, it published a cover photo of a man desperately trying to climb up on the platform of the New York City subway after a panhandler allegedly pushed him onto the tracks.

The man in the photo is moments from death as he looks at the train bearing down on him.

The photo appeared with the words, “this man is about to die,” and “doomed.” It caused outrage among those who thought it was heartless to publish such a photo. Some thought the photographer should have helped the doomed man, instead of taking his picture.

Shock value has always been a tool of the trade for tabloid journalism, and, to some extent its younger media relative, online journalism.

What does it mean these days to “go too far”? Is that idea passé?

There was a time when the personal lives of American presidents were off limits. Clearly, rules change.

Pssst! Hey buddy, over here. Got some really important news for you. Can’t tell you where I got it. But trust me.

That, in effect, is the con played often on the public by some of the nation’s leading newspapers, like the New York Times and the Washington Post. It’s called anonymity.

This con was neatly spelled out in a Reuters piece by Jack Shafer, who counted the number of times the Times offered corrections recently on stories based on anonymous sources, citing anonymous sources again to make the corrections.

That’s carrying the con a bit far.

Shafer traces the history of citing anonymous sources from a time when it was rare, to a time when it was rampant. It’s probably  fair to say that this journalistic disease is especially prevalent in Washington, involving government and political reporting.

Most reporters know that stories are only as good as the reliability of identified sources who are quoted.

“Anonymous sources reduce the pressure on official sources to take responsibility for their utterances,” writes Shafer. “And it promotes the gaming of news outlets, with anonymous sources gravitating to the most pliant reporters and editors.”

Weak or lazy scribes sometimes think they’re acting like “the big boys” by writing stories veiled in mystery, as though they know really important people who want to stay in the shadows. Sometimes these journalists know they are being used, but think that’s how the game is played. With more digging, they might find sources willing to be identified.

The Society of Professional Journalists code of ethics says “the public is entitled to as much information as possible on sources’ reliability.” There are times when anonymity is warranted, such as protecting someone’s life or welfare.

Scholars believe the Washington Post’s Watergate coverage was the “watershed moment for anonymous reporting,” touching off a wave of imitators who lusted for the fame of Bob Woodward and Carl Bernstein.

Getting cozy with news sources is another way to play the game, as Bob Garfield, host of NPR’s “On the Media” program pointed out in his scathing commentary on the White House Correspondents Dinner in a piece entitled “When the Watchdogs Wear Tuxedos, Politicians Rest Easy.”

All of this leads to a point made by Thomas Baekdal, who investigated the meaning of quality journalism. He found that although some of the leading newspaper managers say they are doing a great job, they are losing readers.

It’s just possible that readers are disenchanted with journalism that depends on anonymous sources and making nice with news sources, like the White House correspondents dinner.  It’s journalism with a wink and a nod.

Readers know what’s going on there, and they’re turned off. They know they’re entitled to a better journalism, and better journalists.

 

Ombudsmen a Global Growth Industry

The Washington Post’s decision early this year to dump its ombudsman got a lot of attention, but a global growth in the ranks of ombudsmen as a step toward development has gone largely unnoticed.

“This growth reflects a belief in young or fragile democracies that strong media play a critical role in development,” reports “themediaonline,” most notably in Latin America.

“Themediaonline” report was based on “Giving the Public a Say: How News Ombudsmen Ensure Accountability, Build Trust and Add Value to Media Organizations” It was published by fesmedia Africa, a media project of the Friedrich-Ebert-Stiftung in Namibia, Africa. FES is a nongovernment, nonprofit foundation that promotes democratization and good governance.

An Argentine academic said the work of ombudsmen “demands our attention.”

In Africa, according to the report, ombudsmen organizations play an important role in fending off government interference. Instead of working for news media, ombudsmen in other parts of the world might operate as voluntary associations.

Africa has become a hotbed of ombudsman activity.

Complaints to a press ombudsman in the Johannesburg area jumped 224 percent since 2009, according to a report at the South Africa Editors’ Forum at Umhlanga, Africa.

Johan Retief, deputy press ombudsman of Print Media South Africa, said his organization received 151 complaints from aggrieved newspaper readers and newsmakers in 2009, and the tally is expected to reach 490 in 2013. PMSA is described as a nonprofit voluntary association with a membership of 700 newspapers and magazines in four languages.

Greater numbers of complaints to the ombudsman organization have been laid to growing public awareness of the organization’s public advocate role and its effectiveness in dealing with complaints about inaccurate or unfair newspaper reporting, according to IOLnews.

The newspaper industry’s previous system of self-regulation came under attack as “toothless,” and the governing African National Congress threatened to create a statutory tribunal to hear complaints. That was avoided by a stronger stance by the ombudsmen.

For example, Press Ombudsman Retief ordered the Daily Sun newspaper to publish a front page apology for front page color photos of the bodies of people killed in mob attacks.

Complainants said the pictures were insensitive, dehumanizing, inconsiderate, caused discomfort to society and lacked compassion, according to a report in the Mail & Guardian.

The photos published in October and November also raised concerns that they exposed society, including children, to extreme violence and desensitized people to violent crimes.

Mr. Fix-It Eyes Jeff Bezos

Consumer Advocate Ralph Nader says he is speaking for longtime readers of the Washington Post when he asks how independent the newspaper will be under Jeff Bezos’ ownership.

In an open letter to the Post, Nader says the public has been treated to profiles depicting the new boss’s business successes and his personal style and demeanor.

“What we have not been told is how the newspaper is going to shield itself from Mr. Bezos’ far-flung business interests in order to maintain reader credibility and trust,” Nader wrote.

Nader is known for his bulldog tenacity in making corporate leaders sweat over consumer issues like environmental protection and auto safety. He has some advice for Bezos, who acquired ownership of the Washington Post in a $250 million deal in which he would become sole owner of the newspaper and its publishing company.

“Mr. Bezos would do well to reestablish the longtime ombudsman post which was abolished in March of this year, presumably to save money,” wrote Nader. “For an ombudsman’s role is not just to be an internal critic at the paper but also to be the reader’s coherent voice on the ways the Washington Post is being managed.”

The Post in March said the ombudsman would be replaced by a reader representative, ending a 43-year practice of employing an ombudsman who wrote a long-standing Sunday column.

At the time, Post Publisher Katharine Weymouth wrote that the ombudsman’s “duties are as critical today as ever. Yet it is time that the way these duties are performed evolves.”

New Words for Old Ideas

Every so often, some new terminology creeps into journalism lingo. Sometimes it’s a new concept, and sometimes it’s an old concept cloaked in different words.

That could apply to the term “sponsored views.”

In an interview with iMediaEthics, Patrick Pexton, former Washington Post ombudsman, said “sponsored views” are new words for “advertorials, messages provided by advertisers in a way that looks like journalism, or slightly cloaked journalism.”

But, he added emphatically, “it ain’t journalism.” Instead, it’s brand journalism.

This became an issue, as iMediaEthics reported, when the Washington Post launched a Sponsored Media program on June 12, allowing special interest groups to buy advertisements that are presented as comments below op-ed pieces on the Washington Post website.

The move came three months after the Post abandoned its ombudsman position and replaced it with a reader represenatative. Pexton was the newspaper’s last ombudsman, serving from 2011 to 2012.

The move was motivated by finance, said Pexton. ” The Post needs more revenue,” he said.

Since then, Jeffrey Bezos, founder and CEO of Amazon.com, bought the Post for $250 million.

Let’s Hear It For Ombudsmen

What if the American public lamented the loss of media ombudsmen as much as the loss of sports stars?

When basketball superstar Michael Jordan retired in 1993 from the Chicago Bulls, and again in 1999,  public reaction was strong both times. You’d think he was a member of the family.

Even Sammy Sosa, once described as “the heart and soul of the Chicago Cubs,” provoked an outpouring of some grief when he left the Cubs under a cloud of steroid allegations. A sports writer says Chicago should welcome Sammy back to the friendly confines of Wrigley Field.

Contrast that with the departure of Patrick Pexton as the Washington Post’s last ombudsman. There was some short-lived grumbling in the journalism community, but little from the public. And that’s the interesting part. An ombudsman works on behalf of the public, and keeps an eye on their organization’s ethical standards and relationship with its audience.

The Post had employed an ombudsman for the past 43 years. The Post’s ombudsman was replaced by a reader representative, a staff member who will answer questions and respond to complaints.

Post Publisher Katharine Weymouth, in a column to readers, said the ombudsman duties “are as critical today as ever. Yet it is time that the way these duties are performed evolves.”

That word appears often these days when management justifies major changes. The business is “evolving,” as in undergoing change.

You’d think that an ombudsman would be most useful in a time of change, especially in a time of budget-cutting and layoffs — just to be sure the public interest is served, and the quality of journalism is strong.

But the number of ombudsmen at U.S. news organizations declined in the last few years, according to Marc Duvoisin, managing editor of the Los Angeles Times, who spoke at the annual meeting of the Organization of News Ombudsmen.

What do ombudsmen do? “You hold journalists accountable in much the same way that the media holds the public accountable,” said Duvoisin. They provide “tough, independent oversight.”

It’s the kind of job that tells the public “you matter.”

And it’s the sort of job the public should cheer as much as a home run or a three-point basket from mid-court.

Sacked in Turkey

Ombudsmen in journalism are seen as scolds, nit-pickers, snitches and nuisances — if they do the job right.

People are paid for doing that job right, and sometimes they are fired for the same reason.

The most recent example is Yavuz Baydar, who was the ombudsman for the Turkish  newspaper Sabah. He was criticizing the government and his newspaper, and management decided that either he desist or find work elsewhere.

Baydar was quoted in The Guardian newspaper that his “sacking” was an attack not just on journalism, but on Turkish democracy and freedom of expression.

There are echoes in this from the departure of Patrick Pexton as the Washington Post’s last ombudsman — a job title that had lasted 43 years at the Post.

An ombudsman works on behalf of the public, and keeps an eye on their organization’s ethical standards and relationship with its audience.

In his own departure remarks, printed in the Washington Post, Pexton said “the power of truth is the power to humble governments, to obtain justice, to foil hypocrisy, to help the downtrodden, to reveal the world as it is, not as we might like it to be.”

Baydar’s ousting was noticed worldwide, causing commentary on the difficult role of ombudsmen and shedding light on journalism in Turkey.

Baydar is fighting back, saying he “will take the firing decision to court.”
